I've been calculating my tax return and came to the conclusion that I will most likely get a refund of about $600, give or take a hundred. I, then, did the math for if I was married to someone with no income and came to an approximate $3,000. I told my dad about my master plan to hire someone to marry me before the year ends and divorce them afterward, for a small commission of course. His response was "It's really going to pain your mom when she finds out you don't believe in God," coming from the perspective of marriage being a religious institution. I said this marriage would strictly be a government-recognized act (although I do admit, I don't believe in God for various reasons but I would never tell my parents that), but he didn't really care for my idea. My dad just did the most clam thing in front of my pals. He came downstairs when were all playing VideooGames and he said to me and referring to my friends when he said it, "Hey who invited the clam brigade over, didn't know your mum was making seafood for dinner." My friends were in shock and I was in disgust. Im so emberstomed right now I think im going to be sick, what should I do? my friends are in the other room not talking and my dad is just laughing watching tv in his bedroom, if my mum mum finds out about this I don't think pat and matt will be able to sleep over for the night and its ****ing stupid cause the weekend is my time. Likes to show up and pretend to be a parent a few times a year. I use to fall for it a lot in my teens and early 20s thinking this time it'll be different. This boils down to the wording of the law vs the intent of the law as well as the plausibility of proving the intent at play. As far as the IRS is concerned, if you are married as of 12/31, you are married for the whole year. My supporting document that would support my case is a legally-binding state-recognized certificate of marriage, signed and agreed-upon by both parties. As the marriage is not fake legally and I did not falsify any numbers related to mine/my spouse's income/deductions, this is most likely where the story ends as the IRS is selective about who they investigate (and I would not really be a high-risk/monetary target). If the IRS were to audit this marriage, it would presumably be under the issue of intent of the tax law and if I was abusing it, but that is an unlikely scenario,and not worth the IRS' time. Even if they sent me a notice that I underpaid my taxes and that I filed incorrectly (i.e. didn't file as single), I would surely only be on the hook for that amount (plus any interest, but regardless) which isn't really the end of the world. In the end, I'm not worth it to the IRS. The cost of going after me is more than the return of the $2400. A key aspect of audit is going after high-risk or high-dollar-value areas.
