WASHINGTON The hundreds of pages of classified government records seized from Donald Trump's Mar-a-Lago estate last month aren't the former president's "personal records," and he has no right to possess them, the Justice Department said in a court filing Thursday as it said the government would appeal a judge's ruling on the matter.

The Justice Department will appeal U.S. District Court Judge Aileen Cannon's ruling for a special master to look at the documents seized during the search of Trump's Mar-a-Lago home, according to the notification filed Thursday. The Justice Department said it will file its appeal to the United States Court of Appeals for the Eleventh Circuit.

The department also asked for a partial stay of Cannon's ruling while the appeal is pending, saying "the government and the public are irreparably injured when a criminal investigation of matters involving risks to national security is enjoined."

I hope this whole special master bullshit doesn't delay this stuff too much. I think the DoJ was planning to slow the investigation down until after the midterms any way, but we'll see how this goes. The DoJ has already gone through all of the documents.

Honestly, the special Master thing does nothing other than delay the investigation. There's literally no other purpose. And from what I've been hearing, it's almost certainly going to be overturned because pretty much nobody else agrees with that.

Either way, like you said, they've pretty much already done the investigation, so how much it actually delays the investigation is debatable anyway.

That plan would obviously not work because confidential documents of that level are not subject to executive privilege, especially when you're no longer the executive.

I've read it could be tied up for a year or longer, if the DoJ's appeal is successful, I think Trump's lawyers can appeal that decision to the supreme court, which of course they will.

The SC justice assigned to the 11th Circuit happens to be Clarence Thomas (of f***ing course), who gets to make the decision as to whether they'll hear Trump's appeal, which of course he will. Then it could be a long time before the Supreme Court hands down a final decision after hearing arguments.

And all this before we're even allowed to proceed beyond the special master bullshit.

Kinda silly that a former president can exert executive privilege over the current president, especially when the former president didn't just merely have his term run out but was beaten in a race by the current presiding president. Cause where does that madness even end? Can Obama exert executive privilige over Trump? Can Bush do it to Obama? Is Jimmy Carter actually the most powerful man on the planet and he just hasn't realized it yet?

Appeal has been made. It will probably be overturned pretty quickly.

As for going to the supreme court, Roberts would not approve of an expansion of the president's power, especially post presidency.

Which means by then the GOP could be in charge of the DoJ and they'll kill the whole thing.
