lolol I got an email when I didnt even have email access telling me they started benefits for me a month earlier. I was explicitly told I had no benefits and now they want payment for that month because they didnt bill me for benefits I didnt have or use.

This is such a shit show. Lol

The main cad/cam software doesnt work on my computer lol

But theyre letting me use my Birthday PTO for Friday since I was out on injury when that went past.

Oh hey. We had a designer start a week after me. He quit. I just talked to the main designer and I was told the new guy quit because they did the same thing to him with benefits payments and back charging him for dates before he even started working here.

Tempted to just go home

So yeah, HR didn't like what I had to say and was immediately argumentative. She could not show me where I agreed to a 6/1 deductions, only that I supposedly had benefits from 6/1. They changed their eligibility, but didn't tell people until 23 days later. Then started taking money out of my checks without getting permission. She was extremely argumentative. She wanted to know what I wanted, I told her point blank, the money they took out that was excessive. She refused and then just kept aggressively asking what I wanted, I just told her over and over she knew, as it would not change. I finally got tired of the back and forth, got up to go back to my office in the other building, "If you walk out that door you quit". So... she's claiming I quit, took my badge, and fired me.

Woo.

Just got off the phone with my therapist. LOL

[Manager],

I did not quit. I never said those words. [HR Director] told me if I got up and walked out that I quit.

We had come to a complete halt in discussions. She was very aggressively asking me what I wanted. I could only repeat what I wanted: The money back that they illegally deducted. After 4 or 5 times around this way, the conversation was over. [HR Director] had nothing more to say, I had nothing more to say. I got up to go back to the other building, [HR Director] made the demand that If I got up and walked out her door I quit.

I stress, I did not say those words. I did not express my termination with the company. That was 100% on [HR Director]'s side of the conversation. She then took my badge and terminated my employment.

This is a simple case: The company grossly misstated their benefits; and in doing so they billed people wrong. This is not the fault of the people. However, they do not have the right to arbitrarily back date payments or deduct from an employee's check without expressed written permission.

This was never done. [HR Director], with multiple proddings, could not produce a statement showing I had agreed to a 6/1 beginning of benefits. The only thing she could do is show me that the benefits currently state they were available as of 6/1. This is not the same as them actually being available, or me agreeing to them.

Every single benefit but Medical is 7/1.

[HR Director] Can Not produce a document showing that I agreed to a 6/1 start.

It is also egregious that [HR Manager] only e-mailed me about this three weeks after the supposed start date to say at [Company] had made a mistake. She then e-mailed me one more time stating if I did not e-mail her back she would assume a payment plan.

This is not an affirmative agreement to pay, by any means what so ever.

[Company] then wrongfully took money for benefits I did not have on the checks dated 7/1/22 and 7/15/22.

This is not acceptable. [HR Director] was not interested in hearing anything out. She wanted to talk over me while claiming I was doing the same; yet as the person giving the complaint she should have listened to me first to hear what I had to say first. Instead she came out proverbially swinging with Zero evidence that I approved these charges.

She can not, and has not proven that I agreed to these charges.

When I brought them to her attention, she effectively terminated my employment.

This was a termination in response to bringing up an illegal action, which in itself is illegal.

I want to know what you want to do going forward at this point, I await your reply.

Your statement below is not only inaccurate, but false.

I accepted your verbal resignation as you indicated you lost me as an employee and as you turned around and was heading out the door, I asked you if you were quitting and you indicate what do you think?. I took that as you were quitting your job. As I followed you to the lobby of our building, I asked you if you are quitting, I will need your badge which you willingly handed to me.

My response:

[HR Manager],

You know those statements are false, and I never said I was quitting. Your exact words were "If you walk out that door, you're quitting", then "You quit, give me your badge."

That is exactly what happened, nothing more. Nothing less. You wanted to talk in person so that you did not have a written account for what was happening. You could not prove I agreed to 6/1, and now you're fabricating my termination, which you also can't prove.

I however, can prove I did not agree to benefits to be paid out on 6/1. You can not. This goes very far to the integrity of the statements made.

He got it out of the truck but now cant get it off the dolly...

He called his company... which called me to ask if I could help.

I told them the same thing I told him, no. I have a work injury and they terminated me. Im not touching it until its on the ground. so were just waiting now for a helper from somewhere.
