They're making no criminal referals so it's literally LARP. Respecting a process that yields no results is actually worse because it just becomes circus to trick people into thinking there's consequences to this country's mass corruption. I refuse to pretend these larpers are fighting for democracy or whatever when their inaction will be the cause of the Jan 6th perpetrators actually benefitting in Congress.

That's not true. The committee will be sending all of their evidence to the DoJ in September, according to what members of the committee have said. Making a criminal referral along with it doesn't force the DoJ to prosecute. The DoJ will decide whether or not to prosecute on their own, regardless of whether a criminal referral is sent.

Also, based on what multiple members of the committee have said, it doesn't sound like there has been a final decision made on whether criminal referrals will be made or not. The chairman of the committee recently said they won't be, but other members have come out after the fact and said it hasn't been decided yet.

Looks like it's about to start. The PBS News Hour intro is on.

Looks like this one is going to be focused on Trump's efforts to pressure Mike Pence to refuse to certify.

Mike Pence at some conference (I missed the name of it): President Trump said I had the right to overturn the election. President Trump was wrong. I had no right to overturn the election. The presidency belongs to the American people and the American people alone. And frankly, there is no idea more unamerican that any one person could choose the American president.

Marc Short, former chief of staff to to VP Mike Pence: Mike Pence directly conveyed the fact that he did not have the authority to overturn the election to Trump.

Greg Jacob, on Trump's theory that the VP can select the president:

The first time that I had a conversation with the VP about the 12th amendment and the electoral count act was in early December around 12/7. VP called me over to his west wing office and told me that he had been seeing and reading things that suggested that he had a significant role to play on 1/6 in announcing the outcome of the election.

He recalled that Al Gore had gaveled down a number of objections that had been raised in Florida.

Greg Jacob told the VP that he had a fairly good idea of how this worked. There is a provision of the cosntitution and then an electoral count act that passed in 1887. Greg Jacob advised that he would prepare some notes overnight that would explain the application of the rule.

Greg Jacob concluded that what you have is a sentence int he constitution that is inartfully drafted. VP thought there was no way that our framers would ever have put one person, particularly not a person who had a direct interest in the outcome, in a role to have a decisive impact on the outcome of the election.

Our review, as well as common sense, concluded that there is no way that the VP has that kind of authority.

This former judge guy is painful to listen to.

Judge Luttig said he believed that if Pence had declared Trump the winner, it would have been tantamount to a revolution within a constitutional crisis. Also the first constitutional crisis since the founding of the Republic.

On December 19th, 2020, Dr. John Eastman admitted himself in an email that Trump's fake electors had no legal weight and were DOA on arrival on Congress because they did not have certification from their states.

"..... first constitutional crisis since our founding."

I would have thought the civil war counted.

Judge Luttig basically says there is no historical or legal precedent for John Eastmen's statemetns about the VP being able to count an alternate slate of electors.

I mean he seems to know what he's talking about and I'm assuming is an expert in his field or he wouldn't be called. But yeah, he is slow and it is making it difficult to watch.

Greg Jacobs - We had a constitutional crisis in 1887 because of multiple states having multiple slates of electors. An independent commission was put together to resolve this and this resulted in the Electoral Count Act. The VP has absolutely no authority to object to electors.

I think they need to move on.

Yeah... hopefully the DoJ does something when the committee sends them all of the evidence from the investigation.

Audio and video recordings of depositions from Jason Miller, Marc Short, and Eric D. Herschmann are being shown where they basically said that people thought John Eastman's theory was crazy, false, etc. prior to January 6th.

No it isn't. This information needs to be made public and all of the evidence needs to be sent to the DoJ.

Video of Rudy Giuliani being shown where he's speaking at the rally before the attack. Giuliani claims everything Eastman is claiming is perfectly legal and appropriate.

A letter from John Eastman is being shown where he destroyed his own theory.

Eastman may not have even believed his own theory was legal. I've seen/heard this mentioned a number of times in various ways.
