I don't see how the argument can get made it wasn't about him. Yes she didn't specifically name him, but four days after the article came out Disney fired him from the Pirates movies. So they sure as fuck thought it was about him. Everyone else certainly thought it was about him. I mean is there anyone who didn't think she wasn't meaning Johnny Depp when she wrote that?

Part of the problem is that defamation is a very high bar to cross from a legal perspective. The courts could make the case that if Johnny felt he was unreasonably fired from Disney he would have to take that up in a legal case with Disney. The very fact that Amber didn't call him out, regardless of whether other people read between the lines, seriously complicates things because it sets court precedent around whether someone can be found guilty of defamation against someone they never actually mentioned. Even if they decide that it's obvious enough that Amber was specifically talking about Johnny, and he can prove the causal relationship between her article and him getting fired 4 days later, there's still the issue of the legally binding agreement he signed that said nobody was lying. Much in the way that witness testimony or evidence can be tossed from a trial under specific conditions, his OWN testimony in this case might have to get tossed simply because he had previously contractually agreed that his prior statements were accurate, meaning the court might have to assume his statements here are not.

Are we all sitting here thinking it's obvious she abused him and then lied about it for personal gain? Sure, but for better or worse "common sense" isn't sufficient to win a legal case.

Not for nothing, but I didn't even know Amber Heard existed when he lost that Pirates job. I kinda thought it was just substance abuse.

Defamation is predominantly about intent. All you have to do to weasel your way out of it is prove you didn't intend to ruin their reputation and not actually accusing anyone specifically of anything is a pretty strong argument that she didn't intend to ruin Depp's reputation.

FWIW it's possible that's even the truth. Maybe she just wanted to ride the wave and get some popularity as a victim without specifically bringing down Depp. People have lied about similar shit before blaming perpetrators that would later turn out to not even exist.

Common sense doesn't exist in the court of law, no seriously. I had a friend who lost a court case because someone's kid climbed a ladder to a part of his building that was under construction. The kid fell down and hurt himself because of it and my friend was sued because he didn't have a sign saying that section of his store was under construction nor was there any warnings on there.

Those recordings were unintentionally funny. I pictured a drunk Capt jack every time lol
