Obviously IANAL, but I would be curious if you could really bring about conspiracy charges when the unlawful act is between two consenting adults. It can't be conspiracy to commit a crime if there is no crime to commit.

For instance, if police were to roll up to two people and they see one person hit the other person. Upon investigating they are told that that consent was given which would mean it is not assault and thus not illegal.

It would still be assault, since the act of slapping someone is what assault is in this regard. And it would obviously still be a harmful act whether consent is there or not.

And the conspiracy in this regard would involve:

• ABC/Disney
• The Academy of Motion Picture Arts and Sciences
• Will Smith
• Chris Rock
• The police
• The FCC

If this was a planned event, then that means the Academy had this in the script to happen. They would hedge had to get it approved by ABC, which is owned by Disney. They also would have to get FCC approval since they have rules regarding profanity on broadcast television on the US. They would have also had to involve the police and have them come out with an official statement saying no charges would be filed. And obviously Will Smith and Chris Rock would have had to agree to do it.
