ETA Sorry, should have clarified - wouldn't not hearing testimony lead to retrial? And as lilORang said, how was it determined that SWAT testimony would be relevant?

But that's really not a thing you need an expert for. If that was the case, then I think the trial judge got it right and the appellate judge is just trying to protect the cop. But there may be more to the issue.

True - I'm also not a lawyer so not sure what happens next. Retrial? Charges dismissed?

Here's a better article. Guy gets a new trial. They wanted his SWAT commander to testify to the training the cop received, I guess to say he acted appropriately in the situation.
