Should Kellogs be taken to the cleaners or is this a frivalous lawsuit?




A 5 MILLION dollar class action lawsuit was launched against Kellog's of MISLEADING customers about the fruit content in their frostted strawberry Pop-Tarts claiming they contain few actual strawberries!!

Elizabeth Russett from NY accuses the food giant of padding out strawberry Pop-Tart filling with cheaper pears and apples and demands 5 million smackers and force Kellogs to change its misleading labels

A spokesperson declined to comment to Dailymail when asked for comment

It's not the first time they were sued as a separate lawsuit in August said their strawberry pop tarts are misleading because they give consumers the impression the fruit filling contains a greater relative and absolute amount of strawberries than it does

Anita Harris filed the lawsuit in Illinois pointing out the list of ingredients on the highly processed breakfast food reveals they contain less than 2% strawberries along with pears and apples as they say strawberries offer health benefits that are more expensive than apples and pears and demand they add more in it

It also claims it has even more non strawberry fruit than actual strawberries and the use of red 40 food dye to further mislead consumers and say they exclusively promote strawberries and are duped into believing they are eating the fruit

What say you? Should Kellogs pay up or are these people filing a frivalous suit?

Okay, so, um, this is a really common industry practice for food, and particularly drink. Every single juice in the juice aisle says something to the effect of "from (fruit flavor) concentrate and other juice concentrates." Most of the time it will be apple or pear juice. Usually apple in my experience and then they also add concentrate from whatever flavor they want. Even 100% juice does this, and it's perfectly legal because it's "100% juice" not "100% whatever fucking juice flavor you bought". They do this because apple juice is cheap as hell and it makes a good filler since whatever other concentrate you add will overpower the rather mild apple/pear juice flavor.

And here it's even simpler, Kelloggs last I checked said they have fruit filling. Pear and apple are fruit. More importantly, for strawberry flavored pop tarts, do they taste like strawberry? Yes. There is no misleading advertising. They promised you a strawberry flavored rectangle that can go in the toaster and you got it.

EDIT: Also, if you're buying poptarts for "health benefits", I strongly suggest you find a nice wide mirror and take a long look at yourself.

So, um, there's this list on the box called "ingredients." And it lists everything in the pop tart by weight. And for stuff that's 2% or less they usually say "contains 2 percent or less of:"

I mean I think they do add some vitamins and shit. Like if you are gonna eat some sugary nonsense for breakfrst pop tart is comparatively healthy to a Donut or Frosted Cinnamon Roll or whatever.

No, this lawsuit is doomed to fail. Also, they don't advertise them as being healthy, or really containing a ton of fruit. They're strawberry flavored. This is a bunch of frivolous bs from some idiot. Like the one who sued Nutella for it not actually being healthy and her kid got fat or something.
