As is, its horribly outdated, vague, and nearly impossible to change. Ffs, it still allows slavery for inmates. And obviously the second amendment needs to go so we can actually get reasonable gun laws in.

At this point, we would have to make the new one completely extraconstitutionally, just like the current one was made.
But nothing short of war and/or dissolution could accomplish that. Its basically the Gordian knot, except the knot is in the noose around our necks.

There is nothing okay about the Vesting Clause. No amount of purpose or intent (and given that Article 2 was by all accounts an afterthought compared to Article 1/the BoR, there wasn't much of either) justifies the vagueness on display there.

We have a constitution that prevents us from fixing the current system, but in order to fix the constitution we need either cross party cooperation or near total control by one party or the other, both of which are basically impossible now.

I think amendments to disband the Senate, repeal the 2nd Amendment, and nullify the concept of State's Rights would be pretty good starts. I mean obviously we'd still keep the state names and everything, they would just be what they are, arbitrary regions of the country with their own names. No different than the name of a street with the same amount of right to govern itself. None.

From there it would be pretty easy to divvy up Congressional representation in a fair and equitable manner. No longer bound by arbitrary state borders and the governments that gerrymander themselves, you could just divvy up Congressional districts in such a way that each Congressperson represented x people, where x = USA Population / Number of Representatives.

I think that would be a good way to counter the state of the Republican party where 80% of the country disagrees with their platform yet with the rural bias in the Senate and Governor's Mansions, they are able to stay in power and impose their will upon the majority of the country. 20% of the country would still think universal healthcare and a large Education overhaul is communism or whatever, but they would only be represented by 20% of the Legislative branch as opposed to 55% of it.
