And I never said this case was exactly the same as other cases. I'm just saying we can't separate it from Nintendo's position on and approach toward piracy generally and how that actually and potentially impacts our ability to preserve old games.

It doesn't though. You can back up any of your old games. That's not what this case was about.

Unless they can prove that his actions were willful and malicious, he can just file for bankruptcy. People that owed the RIAA hundreds of thousands due to file sharing used the same method

However, given this dude's aversion to having a lawyer represent him, I'm not so sure

Actually, it's both. And it makes a big difference whether Nintendo will pursue legal action.

True It is both.

The only reason they took legal action is because of the person selling access.

Dunno what's worse, that he was charging for the site, that he tried to defend himself in court against a fucking million dollars worth company, or that he can't pay $50 a month after how long has it been since the site shut down?
