police in England attempted to crack down on hate speech and hate crime against LGBTQ+ only to be told they couldnt actually claim being offensive is an offence and had to apologise, and take back what they said.

Hate crime isn't a thing in UK?

It is, but it must also be a crime by its own merits, otherwise it's considered only a hate incident which are reportable but not immediately punishable (record is kept to help determine if a crime committed later should be tried as a hate crime by establishing a pattern of behavior).

I guess my point is, it seems like a wording issue. The text on the billboard says something like "we will not tolerate hate crime". It's blurry and I can't read it.

I remember seeing this picture a few days ago though and I first thought it was just a benign billboard saying not to do hate crimes. Not that being offensive is a crime. But I guess the phrasing can be misconstrued.

The confusion comes from the fact that the UK actually has fairly stringent hate crime laws when it comes to saying things online. So in an informal sense being offensive online in the UK could constitute a hate crime, which would make being "offensive an offense."

They were just being cheeky about it with the billboard phrase.

It also bears consideration on what qualifies as a crime. Should that youtuber Count Dankula have been tried, convicted, and fined over a comedic youtube video?

I would like to think most people would say no, but that looks to be what happened.
