The Constitution provides that representatives "shall be apportioned" among the states counting the "whole number of persons in each State" every 10 years.


Is the GOP argument that tax-paying, illegal immigrants and their families are not people?

One problem with this is if the citizenship question was struck from the Census, how does the administration know who is or isn't an undocumented immigrant? I can see SCOTUS ruling against them based on that reasoning alone.

If they rule in favor of the republicans this would be the most shameless partisan disregard for the constitution in the court's history.

The constitution is explicit that all people, citizens or not should be counted. There is ZERO ambiguity.
