A 1st degree murder charge would guarantee that Chauvin walks free because there would not be evidence to show that it was premeditated. There's enough wiggle room to argue to a reasonable doubt he was being incredibly negligent and brutal without the explicit intention of killing the guy on the spot while being filmed. Because each degree of murder has it's own classification? 1st is you planned it from the beginning and fully with intent. 2nd is with full intent but not pre-planned beyond the moment (i.e. someone losing their temper and killing someone purposefully). 3rd is without intent to kill, but with intent to harm and accidentally kill. Like in the previous example with someone losing their temper. She was just shot at over the weekend, and is now petrified. She served overseas.
