He didn't go to jail because nobody knows he did it. Hagrid even asks Harry to never mention the incident to anyone.

If anything, it only further indicates that the kid is a potential wizard/witch so they'll consider it a good thing, they'll just memory-wipe the witnesses. Except that the Dursleys are already supposed to be familiar with magic due to the connection with Harry's parents so the wipe step is unnecessary.. Also, the Ministry can only detect magic use, not who used said magic, which means kids from wizarding families can perfectly use magic all they want as long as their parents are OK with it while Muggle-borns are forced to live without magic all the time during school break.
