This seems to be a recurring theme when it comes to abuse of children. The rapist will plead ignorance or blame it on alcohol and the courts will be like "Ok, so you weren't acting normally. Normally you aren't a rapist? Well then you can't be punished for something you wouldn't do in your everyday life!" And the whole aspect of the victim not defending themselves enough is ridiculous as well. If a person attacks you and rapes you, you are legally only only to defend yourself to the same level of attack that the perpetrator is dishing out. So if you grab a knife and kill the rapist, you could find yourself in prison. Fun fact: Korean judges must simply take a test and be approved by a board to get their position. So the court system is almost entirely made up due to nepotism by certain law firms. And the only way a judge can be removed is through being arrested or physically/mentally impaired. That's it.
