A Hagerstown man was found guilty, but not criminally responsible, on a charge that he violated Maryland law by recording a telephone conversation without the other partys permission. Dustin Michael Lee Cavanaugh, 31, of South Cannon Avenue, entered a plea of not guilty with an agreed statement of facts to a charge of interception of communications. Once that plea was entered, Assistant States Attorney Cyrus Jaghoory read the statement of facts in the case to Washington County Circuit Judge Daniel P. Dwyer. Dwyer said there was sufficient evidence to find Cavanaugh guilty, but a mental health evaluation determined he was not criminally responsible for his actions. On Sept. 25, 2018, Cavanaugh called a Hagerstown Housing Authority official and later posted a recording of the call on his YouTube page, Jaghoory told Dwyer. Hagerstown police obtained a search and seizure warrant and confiscated Cavanaughs cellphone and other electronic devices, he said. Cavanaughs cellphone contained a recording of the conversation with the housing authority official, as well as an app for recording calls, Jaghoory said.

Defense attorney Carl Somerlock told Dwyer that Cavanaugh at times does not understand the consequences of his actions. At other times, his client does understand the consequences, but cannot not stop himself due to his compulsion, Somerlock said. Its a compulsion you and I may never understand, Somerlock told Dwyer. Dwyer said Maryland is an all party state, requiring that all parties in a call grant permission to be recorded. Some states allow calls to be recorded without everyone involved giving their permission, he said. Cavanaugh is on probation for an unrelated conviction in North Carolina. Somerlock told Dwyer he has not determined whether the guilty but not criminally responsible finding constitutes a probation violation. Cavanaugh has been held in the county detention center since earlier this year for violating conditions of his pretrial supervision. The disposition of the case means the Maryland Department of Health will have 50 days to evaluate Cavanaugh to determine whether he is dangerous. Dwyer delayed sentencing until after the evaluation. Somerlock said after the hearing that Cavanaugh could be sentenced to be under the supervision of the health department for up to five years. Dwyer told Cavanaugh he could file an appeal up to 30 days after sentencing. Another case was dismissed as part of Thursdays proceedings. Cavanaugh had been charged with calling a pizza restaurant last year, recording his conversation with an employee and posting it on the internet.
