Fork Over Passwords or Pay the Price, New Zealand Tells Travelers
Travelers entering New Zealand who refuse to disclose passwords for their digital devices during forced searches could face prosecution and fines of more than $3,000, a move that border officials said Tuesday made the country the first to impose such penalties.

Were not aware of any other country that has legislated for the potential of a penalty to be applied if people do not divulge their passwords, said Terry Brown, a New Zealand Customs spokesman. Border officials, he said, believe the new fine is an appropriate remedy aimed at balancing individuals privacy and national security.

In New Zealand as in many other countries, including the United States customs officers were already legally permitted to search cellphones and other digital devices as they would luggage, and to seize devices for forensic examination if they were believed to contain evidence of criminal activity.

But the law did not previously compel travelers to open their devices for inspection, either by entering a password or using biometric data like thumbprints or facial scans.
As of this week, travelers who fail to unlock their devices risk prosecution and potential fines of 5,000 New Zealand dollars, about $3,295.

The law applies to both foreign visitors and returning New Zealand citizens.

Do you think this is a good balance between privacy and security? Would this impact your willingness to travel to New Zealand in the future as a tourist or for business? Do you think other countries should adopt or avoid this?

Yeah, I will still visit at some point because NZ is such a beautiful place. I imagine I'll just wipe everything before crossing and keep it in the cloud and restore after, guessing they image devices like everyone other country does at border crossings.

How is that a balance? "Give us your passwords or pay a fine, your choice."

It's not. It's also weird to see people bend over in other western countries and accept the idea that if they leave their country they should be subject to having their phones unlocked/searched upon return (speaking in regard to NZ citizens here). I guess NZ isn't big on the idea of having privacy rights.

Is there a checklist of quasi fascism nonsense to lookup before traveling abroad? I'd hate to travel to what I think is a free western democracy and then suddenly encounter something like this.

Abroad? You're better off staying in your house.

What I've picked up is that basically the rule of thumb when crossing any border is to wipe your phone and have it backed up somewhere in the cloud with a service you trust. After you've crossed redownload everything, depending on your mobile platform setting everything up again could be a huge pain in the ass or easy. Also generally I've heard it is responsible to use a VPN while traveling because as a foreigner you have no privacy rights afforded to citizens of that country. Generally speaking you should redownload everything over VPN.

The best timeline.

Travelers who refuse to give their passwords may be denied access into the country and have their devices detained for up to a week. The agency will also be able to store data and password information indefinitely
