I doubt a smartass remark is going to get things where the diver wants.

If he went around spread rumors and trying to make a lot of people actually believe the diver is a pedophiles, I could see it working. Lol anything to run to a courtroom and see a payday.

This is quite literally what he did. After the initial comment he made several more, both to his twitter base of 22 million people and to reporters who questioned him directly about it. Not one comment, but several reaffirming the theory. That's no longer a "smartass comment". We're talking slander, libel and defamation, the triple whammy of trying to fuck with someone's life publicly.
