Consent requires someone to be informed about their decision, or at least be given the opportunity to be informed. This is uniform and universal in common law. If we want to treat sexual intercourse as a matter of legal consent, then we have to apply the same legal standards. That means deception or defrauding someone for consent is violating their right to an informed decision and, thus, rape.

The truth of the matter is such cases represent a fraction of a percent of the population and, like all corner cases in law, could be handled easily through the legal process as they arise without compromising the intent and spirit of the potential law.

The law absolutely 100% recognizes the sexual identities of indviduals in many situations, currently. It is not some arcane and vexing issue that regularly befuddles the courts, and situations where it is questionable is handled through expert panels and jury deliberations.

The reason these laws do not exist is because it is an extremely rare category of crime and many states simply have not put laws on the books defining them. Many state laws can already be interpreted to apply rape by deception without change, or in some cases already detail the requirements. However, these laws are very rarely tested regardless.

I'm not suggesting the intricacies describing and distinguishing sex, from gender, from gender expression in any way 'befuddle' the courts. I'm saying the court is really only concerned with one of those, gender expression. It's not peaking down people's shorts and actually has no desire to do so.

Let's bring it back. Unless the court is going to insist on a biologically essentialist interpretation of the phrase "I am a woman" wherein it equates sex, gender, and gender expression to one another, a position made indefensible by any modern (1980+) understanding of gender psychology and the shift towards spectrumatic thinking with regards to sexual dimorphism in human beings, a court would have no grounds on which to treat this as an example of rape by deception.
