After actually reading the article this decision seems fair. You have to show that your school actually defrauded you to get your money back because you were defrauded by your school.

The Education Department estimated that the program, under the 2016 regulations, would cost the federal government about $14.9 billion over the next decade.

The biggest change in DeVos' rewrite of the rules: Students who want their debt forgiven will have to show that schools had the intent to harm them, with misleading advertising, a reckless disregard for the truth or financial harm.

We'd save far more than that if we even remotely had any external oversight with military and Pentagon spending, swapped to single payer medical coverage for all citizens... And we'd earn back far more if we bothered to actually tax the rich and large corporations instead of giving them tax breaks that actually result in them being paid tax revenue rather than paying taxes. Betsy devos also profits from the largest student loan companies, so preventing defrauded students from being let off the hook even slightly means that she's benefitting herself at the expense of students.

As someone who works in the industry, this statement is straight up false. It's not easy to discharge your loans through Borrower Defense. The program was fine the way it was, students who were legitimately defrauded were the only ones benefiting from this program.
