I called the restaurant. Main manager wasn't there. I explained what happened to the manager on duty; they said to call back tomorrow as the main manager will be in then and handles money and discrepancies. I told them what they did was theft. No room for confusion, my receipt was clear for the total amount written.

I guess I'll call my bank now but I don't think they can do anything about the overcharge. *shrug*

As someone who worked in a loss prevention department the cops wouldn't make an arrest for under 50 dollars. Yes its theft but the DA isn't going to charge it anyways so the cops don't waste their time.

Maybe your da isn't as busy but I can't imagine there are many out there that are gonna follow up on 5 dollars.

Yes it could be that way. I doubt the restaurant wants to play chicken with a police report. Or with yelp reviews and public internet knowledge that their establishment tolerates theft.

Call your bank/creditor and report a fraudulent transaction. You'll get your 5 dollars back and the cost of the meal because of their behavior. Your card will be deactivated and you'll either have to wait to get a new one in the mail or just go to your local bank branch and get a new card.

CE will always be CE...

TC shouldn't ignore this and is correct to report it to either the police or his bank to get the money back. Also yelp review is a must to warn other customers .

Seems like most on CE do not realize that if the establishment did it once, they probably do it to a lot of customers or change tip amount slightly hoping customer won't care or wont notice. Multiply $5 by a lot of customers, that can escale quickly and be a considerable amount of money.

As far as other fraud is concerned, a majority of credit card fraud comes from systems being hacked and use on questionable websites, not from people writing down your info in the back when they run your card. The reason you and Bad_Mojo are being criticized is because you're trying to downplay paranoia as "just being cautious", when you're actually getting nickled and dimed along the way for it.

The best way to protect your credit card is to periodically check your purchases, which you should be doing anyway (the same way you would balance a checkbook). Modern credit protection does wonders.

So the restaurant decided to give me back $5 (will take a day or 2 via credit return) because they claim it was a cashier input issue and not the server who stole money. They said servers don't handle the cashout finalization. They told me that one of their cashiers accidentally mixed up my receipt with another one at a similar time of my meal and it being only 3 cents difference from my total amount is what confused the cashier to put the $5 added tip amount from another receipt to my receipt.

So no reimbursement of my meal expense because they said I didn't complain to a manager while I was there about the service. They deny any thievery and cited it as a mistake and didn't say much else.

I typically pay cash at restaurants because I hear some places may try to steal your credit card information. Also how would you pay if you went to a cash only restaurant if you only had a card? I also once went to a restaurant and the card machine broke. I was able to pay quickly, but the rest of the group had to wait a long time.
