Probably not. Legal or not by US law, he broke the rules the MLB had in place at that time and it was pretty much the biggest one to break.

Yeah, and baseball has very legitimate reasons, beyond federal law, for banning betting on the sport by those involved in it.

Religious-based arguments in this scenario don't really hold any weight.

I'm with you bro.

I'm just saying, look at your money. In God We Trust.

Christianity carries a lot of weight in the US. Gambling is viewed as immoral and its impossible to argue that it hasn't ruined lives.

So should the government protect people or should people be allowed to walk themselves off a cliff if they are stupid or get addicted?

I'm on the latter side but it's easy to just call that soulless or heartless.

This is probably the main thing.

Let's say someone places a 3 million dollar bet on a team. They could spend 2 million to pay off members of the opposing team to throw the game and still make a profit.

Yeah, except for the fact that people religiously bet on sports, mostly football (soccer) in Europe.
it's like the main hobby of most people who follow sports in Italy.

The leagues can have rules and enforce it themselves

Don't see why the government has to get involved

Its already done extensively in las vegas. Anyone wanting to get involved in corruption and fixing is likely already doing so as the means have clearly been here for a long time.

Only thing this does is allow the common man who doesn't have a bookie, who doesn't visit vegas frequently, to have the ability to put a wager on and have some extra fun with games.

The only question is who gets a piece of the pie. The government will obviously tax the shit out of their profits.

You're not wrong, but you do understand the history of gambling in baseball right? The mob literally fixed the World Series once so in order to protect the sport they put a hard no policy on anybody involved with a team to gamble on baseball.

For fuck sake...

The previous ban on sports betting might have initially been caused by the religious-based arguments, but the fact that it has stayed illegal as long as it has is 100% because of extensive lobbying from the Vegas gaming center (where it is legal) to keep it illegal. You've basically had the gaming industry from the rest of the nation (particularly Atlantic City and the Seminole tribe) actively fighting Vegas to make sports betting legal.

When it comes to online poker. The illegality of that is driven entirely by the casino industry. Now the congress people they lobbied might pass it off under moral reasoning and protecting people, but they were being backed by casinos.

My take (lawyer that works in the gaming industry):

This decision is a huge change but does very little by itself. States can now change their own laws to opt in to sports betting. This process will be generally slow and cumbersome and local interests will fight tooth and nail for every cent.

It will be interesting to see how it gets set up. Some early versions of legislation have a percentage of the taxes going back to the respective leagues which a lot of the gaming facilities are not happy about and there is talk that the requested percentage is going to cut into the margins by too much. I do not think it will facilitate online gaming the way some others do. The Wire Act still exists and the security concerns are a hard sell to most legislatures.

I think you will initially see a few states push to authorize it at traditional land based casinos (NJ, CT, MD, PA, WV) in the near future. Then it will expand beyond that to a few others (CA, FL, MA, MS, maybe NY). I read something recently that said there are somewhere around 17 states that have legislation ready to go -- WV could be up by July 1 -- but really don't expect many of it to go anywhere.

PASPA stopped people from advertising and promoting sports gaming. That was specifically identified as inseparable from the act in the opinion today so in a lot of states you will start to see advertisements for sports betting which is going to be very odd in America.
