I've had people dressed all in black cross the road in front of me at night before and come very close to hitting them. It's not fun but those fuckers are definitely the instigators. Ya, knowing you are driving a 2000 pound car, and not looking in front of you is a thing.

It may be not legal precedent for it to be his fault right now. But to say a driverless car leaves the driver completely without any actionable consequence in nonsense. And if that were true, then the blame will fall back on the manufacturer and you know they aren't having that.

But from that video, there is still about 2 seconds when the driver could have hit the break.

Long story short, none of this has been sussed out. And as with everything else nowadays, we're winging it.

The available video is a low quality dash cam recording...

100% a person paying attention would have seen more, most likely spotting the woman before she appears in the video and being able to react to it.

Like if you were to go outside at night and take a picture or record a video without the flash on, the result would appear much darker than what it really was.

The car still should have stopped or slowed down. Many cars have pedestrian detection that automatically stops if there is someone in front. Lidar and radar should have picked up her presence.

Uber's self driving cars just suck. It should have detected her given that she was in the middle of the road when it hits her. There was enough distance for the car to stop.

Some people brought up a good point itt... the driver would have had a different view than the camera. Unfortunately, it's impossible to tell what the driver might have seen had he been paying attention. Could have seen more, could have seen less.

From the perspective of the camera, I wouldn't have been able to react in time. From a human perspective in the moment, I'm not sure anymore.

If your driving you notice things in the distance. Like her blacking out whatever light source is behind her. I've done that many times.

If the driver was paying attention, which, he or she?!?, wasn't they could have at least hit the breaks sooner and gave the diseased a fighting chance.

I think if the driver is paying attention that doesnt happen. However crossing a road not at a crosswalk in the middle of night with a higher speed limit and not looking while doing so is incredibly foolish. While its sad she died, what the fuck was she thinking? The mentality of they have to stop doesnt mean they will.
