My fiancee called me this morning. She works with two other people that gives out loans. She was telling me that the main office called and was bitching about how they went 4 minutes overtime and if it happens again they would dock a day of work.

Is that illegal? Cause that doesn't sound right at all.

I work in HR.

No, it's not legal to dock a day of work in that circumstance. They could just let her go all together for it though. Either way, it sounds like a hostile working environment.

This. Especially since most work places have some provision or what have you in the paperwork you sign at hiring regarding overtime.
My old job basically banked the overtime into a fund you could either request to have paid, or would be paid in the event of termination/resignation.

Current job? I work OT and they pay me without bitching because I get shit done.

It's not legal. They have to pay you for time worked. If she were to get fired after being docked pay for a day she worked she would have a good case.

What is being talked about is "at will" employment which is a lot (most?) states. They can fire you for any reason except for "protected" things like, you're gay, you're out on FMLA (this one can be tricky), you're black, you're Muslim, etc.

Edit: They could fire her for working late/getting OT but they can't not pay her.

I had a manager once dock my pay a half hour one night after she pissed me off and I stormed out the back door and slammed it behind me. She changed my punch out time to a half hour earlier than it should have been. I knew her well enough to expect that sort of behavior so I went back and edited the same punch out time to an hour later than she said it to, getting my half hour back and adding an extra half hour out of spite.

She ended up getting fired a few months after I left. She had become paranoid and thought this nerdy couple who were newly hired were "corporate spies" and ended up throwing something at one of their cars and broke the windshield. When cops investigated, they did that dumb cliche tactic of "so and so ratted you out" and like a fool, she believed them and admitted to having done it. The owner said she could leave or he could press charges. She chose to leave.

Overall, everyone always got away with all kinds of crazy shit at that place, me included. I always said I was the 3rd craziest person there, behind this manager and another dude who quit within a year or so before I quit. He went on to a similar job and beat a stranger with a wrench over a parking spot and went to jail for a few years. I may have only been #3 in terms of crazy, but I got out of that place without ever having legal issues unlike them >_>

Yeah i have heard about that, but i thought they just (atleast where i live, i dont know the specifics, its secondhand knowledge at best) forced you on holidays, take days off and such.
