Which is dumb. If somebody runs over a pedestrian, they should be at fault, not the restaurant. How we ever let businesses become responsible for so much stupid shit is beyond me.

And it's not like a person on foot at the drive-thru is any more of a threat than a person on foot inside the restaurant, or a person in their car outside the restaurant.


The victim would be the one to sue every party that was there when the offense went down. Your gripe is with them - not the restaurant. They have to protect their ass.

Myself and a couple friends did this at a Wendy's one night, stumbling home drunk from a bar. I think the only reason they let it slide was because it was in the wee AM hours and there wasn't even a hint of a car behind us, and even then it took some convincing.

it's like a safety thing to not do it. i did see some youtuber order riding one of those battery powered kid cars tho and he got food.

i've gotten food on foot before but it was at a place i worked at and me and some people from work were just hanging out in the parking lot talking and the inside was closed but the nice manager was there and we just asked him for some free food and he gave us some.

This. Basically, at least at my experience, we'll turn you down unless you're in a motorized vehicle (I'll let a scooter or golf cart pass, but pedestrians/bikes/skaters, no way). We do get a lot of drunk people at night, and there's a curve in the drive-thru to the speaker so it's easy for a car to speed through, not see/expect someone on foot/bike, and hit them.

I mean at that point, you can wait for a car to come through and ask the driver to order for you and give them the money. We don't give a fuck about that unless you were purposefully being a dick to us (I've watched a group of drunk assholes attempt to vandalize out property since we didn't serve them on foot, call a lyft, and try to come through in that. Completely denied them service and made them waste money on the lyft).

People are harder to see in a drive thru. Especially at night. It would be much easier and much more dangerous if a car sped and hit a person. If a car hits a car that's bad too but a lot more likely that nobody gets hurt.

It's easi to see a big car than a person so it's not the same.

I am not really arguing that part. I guess what I wanted to know is that IF the resturant is not liable for a car collison / accident in their drive thru... wouldnt they not also be "non liable" for a "person accident".


In terms of state and federal law... the pedestrian would have the right of way in most cases. So what I am REALLY saying is that why does the liability change when a drive thru is brought int the equation when in any other circumstance a car vs car or a car vs person incident would fall on the one that was neglent.

After a quick good search on some forums discussion this similar topic, the consenus seems to be TWO things ~

-Robbery prevention
-Safety (not necessarily liable) for pedestrians walking in a place intended for vehicles (ala a person walking in the middle of the street).

From what I can see... there is no real concrete liability on the restaurant ~ BUT THEIR IS A RISK FOR ONE since law suits is like rain here in the US. So it would be up to the lawyers and the courts to argue which side had the most neglience if a person vs car accident were to occur in their property.

Which then brings another question ~ Would the resturant be liable if a person were hit by a car in their parking lot? What about a car leaving a drive thru and hitting a pedestrian while still on the resturant's property.

It get real murky with each spefic case. So I guess it would be determine where the liablity falls based ont the skills of the lawyers involved in the end


Edit: but to reiterate... the MAIN REASON for the no pedestrian in drive thrus seems to be mostly the risk of robbery

See, I'd say Robbery is #1 reason (and that's what we're told), but we don't really check cars if they have license plates or anything. Whenever we explain it to pedestrians/bikers, we say it's a liability /safety/security reason, tho at this point we just say it's against policy and we can lose our job if we serve them. Much more to the point and more people are sympathetic to the whole losing your job part.
