...man, that practice is a lawsuit away from being illegal. there is no way that holds up in courts well for a bunch of jobs.

law enforcement/military however wouldn't be one of them that i can see thrown out easily though. that's a field i can understand this sort of check for. a lot of government positions you give up a lot for, especially those where you have a firearm, so them digging into your personal life is already part of the norm.

the part that gets real troublesome though, even for them, is the password check. that just really can't be legal (and if the cops try to do it to you, oftentime won't be as they've been finding out through the courts). it's too broad a brush to use considering everything else on facebook, including things that can't be asked for.

Asking for a password is a huge and unacceptable breach in privacy. I would be astonished if the courts ruled it legal.

Forcing you to log in or friend a business account are pretty awful too, and I doubt I would stand for either of them.

I've even heard of some employers basing hiring off of what your interests are in certain categories on Facebook.

One of the examples I've heard is that if under music, you have some unknown bands, they consider you a free thinker, and would label you as a threat. But if you have people like Lady Gaga and Rihanna listed, they consider you a brainless employee who will buy into everything they tell you, and are much better for the position.

Well, the military doesn't do it for people actually IN the military.... yet. However they HAVE posted extensive guidelines on what you are "allowed" to post on social networking sites.... which go ignored by about 99% of the population.

I have seen/heard reports that a persons social networking profiles can have an equal, or even greater (depending on the job) then the persons actual experience. That's f***ed up.

It doesn't end with Facebook. Some of your search engines might provide information to employers, creditors, and so on.

Now how about this:

You would obviously take this deal, but why? Because you really want that $10K. But is this exchange illegal? It's against the gamefaqs ToS, sure, but that only means the account will be closed. Neither of us are gonna be charged for any crime.

So the problem isn't about asking for the password, that is merely a symptom. The real problem is that employers have way too much leverage over the job-seekers in this economy. It's 100% an economic issue. Fix the economy, and the balance shifts towards the job-seekers, and ALL symptoms are fixed, not just this ONE, SUPERFICIAL, INSIGNIFICANT symptom.

The problem is simple enough that to solve in legislation without a vague law open to tons of unintended side effects: "Companies may not request that job applicants or employees give them passwords to any personal accounts." I don't see any reason not to do that.

You know what, I was thinking about this and I wonder if some companies might be cutting corners on background checks with this. They can spy on your Facebook for free but real background checks cost money, I wouldn't be surprised if there were at least a few companies who thought Facebook spying was good enough.

My view, and this is where 2 reasonable people can definitely disagree, is that piling on the minor legislations like this makes it harder to get out of the economic slump. It's not only unnecessary, but harmful.
