Important to be specific on this.

The SC wouldn't be prohibiting interracial marriage. They would be overturning Loving v. Virginia. This would take the question of interracial marriage back to the states.

And THEN the MAGA states would pounce.

Also I think the Respect for Marriage Act was mentioned earlier.

A state making a law banning same-sex marriage or interracial marriage would NOT be in violation of the RfMA.

Because that law says that all states must recognize any marriage that took place in a state where the marriage was legal.

So a state banning certain marriages would have to respect that kind of marriage from someone out of state, but they can still prevent new marriages from being recognized AND declare marriages that took place in their state as unrecognized.

I'm surprised that a state law banning homosexual marriage hasn't been challenged and passed up the courts to the SC yet...
