This bill is shit

If Obergefell is somehow struck down, this bill still gives states the rights to not recognize the marriages

Its a bad faith move by republicans to try and appease people when really it won't do anything

All this bill does is mandate federal recognition for marriages performed in states where it remained legal in the case that Obergefell is repealed

If a state outlaws it, this bill doesn't do anything for that state

It means you have to take a short trip to get married I guess but there's limits on how much federal law gets to decide what be states can do.

If the federal government was the one granting marriage licenses it'd be different.

The only way states can call this bluff, is by ending legal marriage entirely, and even then the wording of the bill specifically grandfathers existing marriages.

I see this one going to SCOTUS quickly. Could have gone the Drinking Age Act vector, but there's too much risk of losing that method.

Now if Obergefell can just be overturned, why can't any republican state just make up an excuse to challenge whatever bill gets passed and have the SCOTUS strike it down?

Its not like the SCOTUS is even pretending to be politically neutral at this point.

The question we really need to be asking is: if marriage is a right, why do we need a license to do it?

It's always important to codify this stuff into law, the fact they sat on court rulings for decades knowing Republicans wanted to stack the SCOTUS is just beyond irresponsible.

I'm highly suspicious of any bill where there are several Republicans claiming to support gay marriage in any meaningful way. I'm pretty sure that conflicts with their base and their party platform. This is just going to be something they use to say "look the hysterical left says we hate LGBT people and wanna take their rights, but we passed this Swiss cheese law, they're never happy"

The scenario of a state stripping "marriage" from law, could plausibly ram into 7a and 7c.

I think its an attempt for the non-MAGA republicans who are basically just trying to make them look a little better when we look at them in like 15 years after MAGA envelops then entire party and the people who like, quietly want the poor to die and huge systemic problems to only get worse look a little better because they threw a bone every now and then.

After the MAGA crowd completely takes over the Republican Party and all these people are ousted, they're expecting stuff like this will make them look better than actually seeing the crap they pulled.

all bills must pass both chambers, and then not be veto'd, to become law.

vetos can be overturned but it takes a supermajority (i forget what exactly)

no this one is going to pass. the senate requires 60 votes (out of 101) to pass, so that's where it died. the house requires 50.1% in favor. the senate is always the "hard" place. the senate is what cleared trump, for example, even though the house impeached him twice.

so, having already passed the senate it seems like it's a sure thing.

It already passed the house, then the senate added some stuff, and now the house has to pass it again.

I peered into the conservative discussion on the internet and it's baffling to me that a lot of people are so forthright in 2022 that they're still anti-gay-marriage. It's such an unpopular stance to have now I thought the Republican party tried to just kinda sweep it under the rug that they were fighting tooth and nail against it just a few years ago. The renewed interest in it apparently exposed the beliefs people never dropped though.

they stopped being as overtly anti-gay marriage when Trump ran for office because he loved the gays
