He was asking about Texas House Bill 362 in regard to the issue that I was fighting with my HOA about last year. Even though the separate Texas property code law exists that says HOAs can't prevent home owners from installing solar energy devices, it looks like they are going to move forward with changing the language of the HB362 to make it more clear that HOAs can't prevent people from installing solar roof tiles. Nice.

A friend wanted to put solar panels on the roof of his Dallas home and the HOA was going to allow it but only a certain type and color. The requirement was unreasonable to the point that it functionally prohibited him from doing it but the HOA was still within their rights to do so. Does this change help him at all?

Yes, the HOA is pulling those provisions straight from Texas HB362. However, send him info about Texas Property Code Title 11 Chapter 202 Sec. 202.010. This is a separate state law that says HOAs can't prevent people from installing solar energy devices. That's the same fight I went through. I'm now just waiting on Tesla to get through some supply chain issues before installation.

Can't believe I'm actually getting a state law changed. This is the most impactful thing I've done.

If I find the time, I might try to figure out how to contest Texas' dumb ass rules about no-excuse mail-in voting since they blatantly discriminate based on age.

Now you just have to hope that the Texas GOP doesn't block it because they think renewable energy is evil or whatever, or that they don't waste what few weeks our state lege is even in session every other year on anti-gay/abortion/CRT Bill #9001, and don't have time to consider it.

Yeah. My problem with it, primarily, was that it was written before solar roofs existed for home owners. It was only a commercial product at the time.

Would you mind letting me know how it goes with your friend fighting with his HOA? When I sent my HOA that Texas property code law, they responded with approval within a couple hours, which is drastically faster than they had ever responded previously.
