In my opinion:

  1. What an employee does during their off hours is their business and their business alone. Employers shouldn't have the right to meddle with what employees do outside work, unless they do something blatantly egregious like the January 6 riot, appear as a racist Karen in a viral video, or allow their children access to guns used in mass shootings.
  2. If the employee is in a tough enough spot that they need to moonlight in the first place, you're doing them a huge disservice by firing them and cutting off another source of income for them. Why would you ruin the life of somebody trying to make an honest living or two, as long as it doesn't impact their work?

I just don't understand the sense in firing somebody just because they have loyalty to another company. If Dave at the office wants to deliver pizzas at night because his day job doesn't pay enough, then he should be entitled to do so. Why would you fire Dave from his regular job just because he has to deliver pizzas at night to make ends meet?

In the USA you can be fired for any reason other than race, religion, gender, etc.

If it's in an "at will" employment state then it doesn't matter why you get fired.

@PatrickMahomes

All 50 states including Washington DC are at will employment.

The entire United States is at will employment.

I don't think having two jobs is illegal in most states.

So you can get a criminal record and do jail time for moonlighting? Have cops show up with a warrant and get arrested?

Big employers usually have secondary employment policies.

Here, you generally just have to sign something to say there are no conflicts of interest and that your secondary employment wont affect your normal job.

The workplace should have no say how you live your life outside of work as long as youre able to show up sober and well-rested enough to do your job. They should have no right to test people for marijuana that they use when the shift is over and they should have no right to prevent you from taking a second job (which you wouldnt need if your job paid you enough).

Listen I don't agree with it but I'm saying it's against the law so employers will fire you if they know you're doing it.

Wait, its not just having a 2nd job. Isn't it something like if you're a doctor within a certain hospital network you can't just go work for another hospital.
