A Denver judge says a baker who won a partial victory at the U.S. Supreme Court in 2018 for refusing to make a wedding cake for a same-sex couple violated Colorado's anti-discrimination law by refusing to make a birthday cake for a transgender woman.

In a ruling Tuesday, Judge A. Bruce Jones ruled that Autumn Scardina was denied a cake that was blue on the outside and pink on the inside to celebrate her gender transition on her birthday because of her transgender status.

While the Masterpiece Cakeshop, in Lakewood, said they could make a birthday cake for the desired number of people, baker Jack Phillips said he could not make this particular cake because of its message.

The judge, who said this is about refusing to sell a product and not about compelled speech, also ordered Phillips to pay Scardina $500. Phillips plans to appeal.

Citing religious beliefs, Phillips made a similar argument in 2012 when he refused to bake a wedding cake for a gay couple. The couple filed a complaint with the Colorado Civil Rights Commission.

The case eventually made its way to the Supreme Court, which partially sided with Phillip saying the Civil Rights Commission showed hostility toward religion.

These businesses thrive due to the infrastructure provided by all taxpayers in the area. such as roads, the police, fire departments etc.

Businesses shouldn't be able to discriminate simply because they are supported by the community, directly by business or indirectly via the reasons I outlined.

I think its a tiny bit suspicious that the trans woman in question chose this particular bakery for her cake (only because I cant imagine being part of the LGBT community and not knowing the name of the bakery that went to the Supreme Court because they refused service to my community) but frankly, I dont care if she was intentionally trolling them or not. Make her the goddamn cake. Her money is as good as anyone elses, and while you might be able to make the argument that your religion doesnt recognize gay marriages as valid, certainly theres nothing in the Bible that says trans people cant have birthdays.

If Im checking out a place for the first time, especially for something like getting a cake made, Im definitely checking out reviews.

And seems like this place had the same issue back in 2012 so that probably would have popped up and Id move on to the next place

I don't understand this ruling, I mean the judge has to know it will be overturned on appeals when it goes to a judge above him. The Supreme Court already decided on this issue, so it is essentially settled law and this judge is violating a Supreme Court decision. Regardless of how anyone feels about this baker or the court case, he has every right to refuse to make a custom cake as long as he doesn't refuse to make a generic birthday cake according to the SC. Though I'm going to guess that at this point everyone in that area knows who the baker is and that's why this individual went there to try and bring the case back to court in the hopes of having it go to the SC again and be overturned.

It has nothing to do with that and everything to do with checking to see if the place is good.

If Im trying out a new place I want to see pictures of their stuff, menus or whatever, reviews, it has nothing to do with what youre saying. Now if something awful pops up when youre checking these places out, you know to move on and not give them your money or time.

The other dipshit poster wasn't suggesting that. He was saying the transgender person should have checked to see that the cake shop in question wouldn't discriminate against them.

That is not something people normally have to do everyday. You are saying that it is reasonable to check reviews of a business in regards to their product quality and then concluding that it is also totally reasonable for LGBT+ people to have to check businesses to make sure they won't be discriminated against.

Yup. That's pretty much exactly the point. There are some problems the free market can fix but this simply is not one of them. What conservatives are really pushing for is the "freedom" to basically shun groups they don't like out of existence. Too many people responded to this situation back in 2012 like "who cares it's just a cake shop, go to another one!", but the problem is a SC decision could potentially have much farther reaching consequences. If the SC gets stacked with 9 conservative justices and another case like this makes it up there it is entirely possible we end up with it being legal to totally refuse any kind of service to LGBT+ people for "religious freedom." Basically LGBT+ would all have to go back into the closet if they want to survive. That's what conservatives want but they package it as "freedom from government regulation." It's the positive vs negative liberty dilemma.
