RomUniverses Matthew Storman actually decided to try and fight Nintendo in court, and whats more, to do so without an attorney. That did not go well for Storman, where his defencebased around disputing that he uploaded any files to said websitewas swiftly picked apart by Nintendos actual lawyers, who were able to point to Stormans own sworn deposition where he admitted to...uploading ROM files to his site.

Its important to note here that Storman wasnt simply hosting pirated copies of Nintendo games, he was also selling premium access to them, where $30 could get users faster access to ROM files. During the last year of RomUniverses operation, Storman says he earned between $30,000-$36,000 from these payments.
No sympathy.

What's random is the Rom site I found when I first discovered such a thing exists is STILL around. I found it in 9th grade so that would have been 1999/2000.

I remember being in a computer class and someone took over the computer next to me remotely and I saw Link to the Past boot up. I was SO confused about how someone is playing an SNES game remotely at my school. Forced me to look it up and I discovered emulators and roms.

Hard to defend him when you get to the actually selling them for profit part, but for the most part fuck Nintendo. This company won't even put a virtual console on the switch and give access to its old games.

Still a funny amount because no way he's ever gonna pay even a tenth of that amount, meanwhile Nintendo is gonna have to pay all their lawyers and shit.

This isn't necessarily true. I work for a large Fortune 500 company and we almost never use our corporate lawyers to go to trial for two main reasons.

1) Corporate lawyers require a different skill set from trial lawyers. It would be like hiring a dentist to do an optometrist's job. Our lawyers obviously assist in the preparation of the case, but the trial lawyers would actually be the ones to show up and do the talking.

2) The corporate lawyers have to be licensed in the state (or country) where the trial is happening. As you can imagine, this is a pain in the ass. Considering how large the company is, there are law issues big and small popping up in practically every state, yet we only have about 8 corporate lawyers.

For these two reasons, we frequently have to hire 3rd party counsel to represent us in court. I wouldn't be surprised if Nintendo had to do the same. Especially considering how international they are.

To be fair, it's not selling access to the ROMs, it's selling access to unlimited bandwidth. Lots of file sharing sites do it. NexusMods (PC modding community), for example, limits free members to 2 Mb/s, and you have to buy premium to download things at higher speeds.

But yeah, that guy was stupid.

Question for the CE legal experts here

If the dude actually wasn't stupid and had a lawyer, could the lawyer make an argument about games that Nintendo can't legally sell anymore, to keep his client off the hook for having to pay out for those games?

For example let's say 21 of the games the dude is on the hook for on his site were for third party titles (NES, SNES) where the company that developed them went out of business, and Nintendo can't legally remake them or push them to their Online service anymore.

Could the lawyer argue (and how likely would it be successful) that for those 21 games (out of the 49 the guy is on the hook for), Nintendo can't make any money off of them legally, and thus the guy shouldn't be on the hook for paying Nintendo for those? Reducing the 49 to say 28 games he has to pay out for?
