The judge has ultimate say over what evidence is allowed in court including illegally obtained evidence. SCOTUS ruled that as long law enforcement "acted in good faith" they can use evidence obtained without a warrant for prosecution. The biggest problem they face is proving the data actually came from Parler since it was a third party that hacked the info and it could easily be tampered with before getting into the hands of the feds. SCOTUS ruled that as long law enforcement "acted in good faith" they can use evidence obtained without a warrant for prosecution. The biggest problem they face is proving the data actually came from Parler since it was a third party that hacked the info and it could easily be tampered with before getting into the hands of the feds.
