You are judging a murder case. You have the final say in judgement. Four of the five are guilty, the other is innocent. You cannot narrow it down further. The punishment for murder is death. What do you do?

You can execute all five, claiming the innocent life to ensure they can't kill again.

You judge that their average guilt calls for all five to be imprisoned but no executions.

You release all five, believing knowingly punishing an innocent is too high a cost.

Legally you need to set them free then...

There is one judgement to be made for each individually. None of them have been found guilty beyond a reasonable doubt.

I can't think of a scenario where you could prove 4 of a group of 5 people did something beyond a doubt but not know which ones it was

No I would not, I would lay down my life to make sure 4 killers were punished, if I had to sacrifice to keep those shit stains off the street that is an easy one.

They all go free. If four people are guilty, but I don't know who, then the prosecution's evidence has only established that four people were involved in the murder, and has failed to establish the guilt of any of these individuals.

Oh, if its a case of four people murdering a person and the fifth being an accomplice but not actually participating in the murder, kill them all.
