As much as everyone would like to see him get a harsher punishment (including myself), 1st degree murder implies premeditation. There's no way to prove he'd been planning to kill Floyd. If he were to get it, it would be downgraded pretty quickly. She wasn't sure they ever interacted, and iirc she couldn't even be sure they had ever worked on the same night. And it also states that premeditation means that he developed the Concious intent to kill and he definitely did.
