That's not how this works. As much as everyone would like to see him get a harsher punishment (including myself), 1st degree murder implies premeditation. There's no way to prove he'd been planning to kill Floyd.

I do feel like if cops want to consider themselves above non-cops, their punishment should be harsher when convicted.

Good news, but it should stay at 2nd degree. In this specific situation, it would be practically impossible to prove the 1st degree on him. If he were to get it, it would be downgraded pretty quickly. You have a good case for 2nd or 3rd, pretty much no case for 1st.

I thought the reason they went with 3rd degree murder was that they couldnt nail him on anything higher than that. What changed? You dont want to over-charge someone because it makes it more likely that the defendant will walk from you mishandling the case.

The family's autopsy came back as clear asphyxiation from pressure on the neck. That coupled with the video evidence is pretty cut & dry.

Yeah the fact that he didn't reduce pressure or take his knee off when he was saying he can't breathe is enough for 2nd degree. Video evidence was good enough for 2nd degree, but I guess they have to make sure he died due to that.

That's what I was thinking. Seems like the higher the charge, the more likely he is to get off free.

It depends on the state, some states there is technically no such thing as 3rd degree murder.

The manager of the club said one of them worked the door while the other worked inside. She wasn't sure they ever interacted, and iirc she couldn't even be sure they had ever worked on the same night. Both were just occasional extra security.

It depends on the state, some states there is technically no such thing as 3rd degree murder.

The only states with a murder 3 charge are Minnesota, Pennsylvania, and Florida

Yes. Juries are often given the opportunity to vote on a lesser crime during deliberations. I know for a fact that this was the case in the Botham Jean shooting case. The jury had the opportunity to convict of either murder or manslaughter.

The legal definition of "premeditated" is much, much broader than you think. The 7 minutes of keeping his knee there easily qualifies, even if it turns out the men had never met before (unlikely).

But that charge is unlikely to stick, so unfortunately there is justification for lighter charges.

What Derek Chauvin did definitely falls under first degree murder.

The definition states that the offender must have intent. Which is obvious from the video. And it also states that premeditation means that he developed the Concious intent to kill and he definitely did. He was very deliberate in what he was doing.
