If everybody knows what the punishment for a specific offense is they will refrain from doing it, instead of trying to gamble the system because they might or might not get punished, and the ones who do get punished won't be disgruntled since they'll know their punishment fits the bill. Also the idea of tenure is bullshit. Imagine a guy shoplifts a condom and gets life sentence because he is 18 and/or he has been living in the county for 2 months, while a 50 year old guy robs a bank and kills 10 people and he gets a $500 fine (and that's it) because he is 50 and he has been living int the county for 30 years.
