Conditional consent is real, and violating that is absolutely rape. If the condition was that he wear a condom, and he didn't then that is rape. If a woman lies about being on birth control, or a guy lies about having influence that he could use to help their career, that's rape too.

A Lie by omission is also a violation of conditional consent if the conditions are understood by both parties. If you have a transmittable STD and don't tell your partner, but you have reason to believe they don't already have it, failing to disclose that is just as bad as saying you don't have it and it being a lie.

And yes, if a man is conditionally having sex with a woman that he believes is a cis woman, and she's actually a trans woman and does not disclose it, that is rape too. There is nothing different about that scenario and the scenarios outlined above. You could argue it does no harm, but neither does saying you were a movie producer. It is a willing, fundamental violation of the conditions that the man consented to.

Oh, okay. Yeah, that I misread what you said. If it's all implicit then it would certainly not be rape because it's up to consenting adults to voice any concerns they would have explicitly if they have some specific condition that would otherwise not be assumed. So at worst if a trans woman was under the impression that a potential partner would be upset if they found out and didn't say anything, it would be a shitty thing to do but certainly wouldn't be rape.

I'd say it's probably legally not rape because there's pretty much no way you could ever get someone convicted of it unless you have it all on video. You'd need to prove malicious intent, but the guy can simply claim ignorance. But morally, I'd say any major parameter knowingly changed during a sexual encounter without the other party's consent is definitely an act of rape.

After much consideration, I think a suitable term would be rapelite. It's rape, but rape in the same way that Diet Coke is Coke. You know, guilt-free rape. That way, when a highly distinguished gentleman decides to perform a sex act on a girl she explicitly told him not to (and lied about it along the way), he can say

"well ackchyually, that wasn't rape. That was rapelite."
