It has to do with whose paying the bills or taxes. Because the tenant is paying rent and not paying most bills directly or taxes, then no.

That's such a stupid law. It would be one thing if the person died and had literally no family, but they should be able to look up to see there were relatives during the application process. For anything like that, he should need to show something like certified letters going out to the owners on a yearly basis stating his intentions and then he gets it if they do not contest it.

Adverse possession is a thing in America, too. My parents took care of an empty lot next door to their house for well over a decade that just never sold as it was an obvious mistake leftover from when the plots were laid out as it was like a third the size of other lots in their neighborhood, and after years of that they legally gained possession of it as well.

Because if a property is abandoned it causes issues. If someone puts in the effort to put the place into, and maintain, a good condition it benefits the area and they should be rewarded for it.

Its quite possible that the tenant poorly maintained the place.

That or existing problems got worse/new ones cropped up in the abscence of a resident.

For example a cockroach problem could become far worse with no one trying to control it.

a family left their home to take care of a sick relative and came back to find someone living at their home claiming pretty much what this guy said that the house was abandoned

in this one the original owners should at least get all the money he made during all the years before the court gave him the house

because breaking into someone property (abandoned or not) and renting it has to be illegal!

One of the elements of adverse possession is you have to be open and hostile about the property. In this context hostile means that youre using it in a way that demonstrates you own it and do not have intentions of allowing other people access.

Adverse possession on a chattel is pretty rare, but for real estate this element is proven by putting up a fence or a no trespass sign.
