I'm constantly getting speedtest results like this even though it's much lower than the speeds I'm supposed to be guaranteed.

And I have texts from an AT&T lineman saying they dont have enough Bandwidth to service the DSL customers.

Can I sue them?

Do you have any other options for ISPs? At the very least there is a small chance they'll let you out of your contract if they can't hold up their end.

lmfao, what?

Have them come out and replace your equipment, and if it's still below advertised then threaten a lawsuit/switch carriers. They'll probably end up giving you a couple months of free service and promise to improve the speeds. TWC once gave me three free months in a row after not being able to solve the issue I had.

My only other option would be fixed wireless. I've talked to Spectrum who apparently somehow owns the rights to this area but it doesn't seem like they're going to service this area or if they do it will be a while. I could afford better internet, just nobody is willing to bring it out this way.

It's still false advertising and I'm paying almost $100 a month because I have to pay for a phone line in order to have this internet service.

3.0 download at the peak but since there are tiers and the one below it is 1.5 download, my speeds are never supposed to dip below that speed.

you can sue them for actions that harm you
you can claim breach of contract for anything that violates the terms

chances are, speeds slower than advertised no neither of these to you.

grow up. SAD!

If its in your contract that you are entitled to speeds that are over the minimum the majority of the time and they rarely ever are you could have a case....probably not worth fighting though.

The lawyers will come down on you like a wall of explosive bricks.

I've been in that situation. A company sets up a local monopoly on this stuff and many people are intentionally left with the bad network. You pay a flat rate, and then you have to keep paying and paying to get more data. Watching a show on amazon, for example, will destroy your data. Then you have to BUY more.

It would end up being a class action lawsuit though. AT&T has basically set this up where there is zero incentive for them to upgrade our service.

I pay for $50 a month for 3.0speeds download speeds, if they offered me their Uverse service, it would be $50 a month for 12.0mbps download speeds or $30 a month for 3.0mbps speeds.

My internet is getting to the point where if I want to play multiplayer video games, I have to play off my phone.

I bought COD WWII, it took 2 days to download the patch on my home internet.

I can tell you that in Canada we have a way to escalate these issues above the ground level of the ISP if they fail to adequately resolve them. Telling them youre going to get the CCTS involved usually makes them fix their shit pretty fast.

I dunno if there is an similar agency in the US/your state though.

Yeah, I dunno who that would be around here. I know we gave them billions in tax breaks to improve their infrastructure and I don't know that they have. I really believe AT&T is trying to push fixed wireless on us which might be better but I dunno.

Doubtful. Most ISPs advertise "speeds up to [advertised speed]" specifically so they can't be sued for slower speeds.

Unless they stated a minimum level, you can't do shit about it. With the stupid regional monopolies we are fucked beyond belief.

At one time it was 1.5mbps. I assume its still the case because a speed dip lower will prompt them to send out a technician. I've had about a dozen technicians come out this year. I personally believe my phone line is fried due to a huge electrical surge earlier in the year but they won't consider replacing it.

Keep having technicians come out. That costs them more money than you're paying them. If they can't fix your shit at least make sure to be annoying as fuck. Call them EVERY DAY.
