Was Leon S. Kennedy in the wrong for killing the first guy in Resident Evil 4?

Leon broke into a guy's house and could have easily just run away after upsetting a guy who didn't appreciate a stranger in his home

If the guy wasn't an infected zombie then yea he'd be wrong. But there was no hope for that dude

This zombie was using a tool and was able to speak. So any person that's a bit eccentric or intoxicated is a "zombie" to Leon?

He was speaking a foreign language and thus was an immediate threat.

Im actually not sure I was right about that after deeper thought. Think my mind painted a picture of mixed RE games

I don't think Leon encounters any bodies until the woman with the pitchfork through her face in the shed a little ways up the road.

Let's review the Leon's first encounter.

-he walks into a home where the front door is opened
-he sees a guy tending to his fireplace. to get his attention he says "excuse me, sir?"
-guy swings axe at Leon as he reaches for a picture of Ashley
-Leon tells the guy to 'Freeze', but guy continues walking toward Leon with an axe

It wasn't as he reaches for the picture, it was immediately after he showed him the picture.

Like a police office should, Leon gave the man multiple times to cease his attack before he used lethal force. Even with a language barrier most people understand the gravity of having a gun pointed at them. But the man seemed unfazed and continued his attack. Though if Leon didn't know he was infected or anything about the plagas then I guess you could debate he could have tried to incapacitate him first.

It was only after that encounter that Leon found the "altar" with rotting skulls in it under the stairs to the second floor. Before that he had no idea there was foul play other than a man coming at him with an axe.

Then he exits the house after hearing what is obviously cars interacting. And if went up the road a ways before entering the house you can see the path blocked off by a large covered truck. Which is what forces you into the house to see what you can do about the blocked path. Only after jumping through a second story window do men again outright attack you with no provocation, thereby sealing the deal that indeed something fishy is going on.

You can't incapacitate him. You're allowed to freely shoot stuff like his feet, arms, or shoulder but he shrugs them off.

Leon S Kennedy was in the wrong for just standing there while the big bad talks trash instead of just shooting the fucker in the face.

That happens like 19 times in every RE game.

Initially Leon didn't know he was more than human. I am saying I guess people could debate as a police officer at what point does an officer move from verbal warning, to trying to incapacitate, to lethal force when he life might seemed to be threaten. All Leon was filled in on was the president's daughter was missing. He had no idea this shit was gonna go sci-fi on him.

I mean, Leon does warn him. You then have control over Leon after that and you're free to attempt to incapacitate him. The thing is, he's impossible to incapacitate because of the plagas so he might've saw that in canon too.

Fair enough. I can go along with that too since they didn't in the cutscene have Leon take any other action than warning the guy.
