You can suffer prison time for firing a warning shot. You're basically showing reckless endangerment to those around you, and presumably before you even feel your life is in danger since you obviously didn't feel you needed to shoot the person.

The killer needs to face repercussions for ending this person's life, whether they let him off light due to some sort of insanity plea circumstances or what, I am not a judge. But no lawyer will stand behind "Your honor, my client fired a WARNING shot!".
