Though to be fair, the definition of tailgating has crept so much that you pretty much have to ram someone to count. Seriously, try it sometime. Count seconds from the car in front of you passing a sign or pothole until you do. I guarantee you it's less than 2 unless you're so far off in the middle of nowhere that there's just nobody ahead of you.
