You have the option of imprisoning Gammel when you see him the first time, that's the execute option at the time. If you do that, he escapes then you fight him again later & actually kill him then. Not every option is a kill every single time or a spare, I was only saying that there are cases where if you just spare you can miss out on some things & vice versa.
