The only scenario Miles retaining the name makes sense is one where Peter is dead. Which is something that obviously never going to last, even in the ultimate universe.

Eh I don't think "Actually he's only Spider-man if Peter is dead so if he isn't he should be called something else" is all that good. It ruins the point that he's a proper Spider-man.

I think it's fine though. Peter considers him Spider-man. So he is. Peter doesn't seem like someone who thinks there can be only one Spider-man.
