Oh the answer to this is both simple and horrific.

Whenever a-new baby is born, a DNA test is taken. If the X-Gene is located, they are added to the registry as a potential mutant. About 13-15 years later, that kid is then assessed for any developing mutant power and the registry is updated, additional assessments are done every 5 years for any secondary mutations. That way you know if double dick guy is a mutant who needs to be on a public registry or just a dude who has two dicks for non-X-gene reasons.

So it just requires the government to DNA test the entire population, regardless of criminal record.
