So fair, it doesn't necessarily contradict the rules, but it certainly warps them a bit beyond expectation. I don't think anyone would reasonably expect 7 Town / 4 Scum to change the voting style, but with a Gladiator, that is totally in the realm of possibility. Gladiator match kills town + King mislynch on town + scum nightkill = game over. So in the case of 7 / 4, we'd have to do majority rules, which just seems odd without prior context of having a gladiator.
