It would probably apply if he had attacked them and continued to struggle and try to attack them while they restrained him. Which isn't really unbelievable when reports state that police were called to the home because he was behaving "erratically and aggressively", he had assaulted the responding officers, and he assaulted the JIAC officers after they gave him a verbal direction to return to a holding room after he tried to pull a computer monitor through a window.
