Fine, Fair dealing then, which is something not quite used in American law. A Canadian federal judge during the Napster debacle with Metallica pointed out that gaining music off of Napster was no different than requesting a song off the radio. It's also why for a very long time after that, that Canada didn't have as strict of copyright laws as were down in the states. We just weren't dicks about it and overconsumed. You could access older media for free, you just weren't allowed to sell it for profit. There was a gray area whether you should do it or not, but cops weren't busting down our doors for a few movies downloaded during the early 2000s.

There is a lot of media that will disappear if not replicated via the web, or distributed through individual mediums. And I'm not against paying for media. I would gladly pay Nintendo 5-10 dollars for a old game, but lets be honest here, their storefront sucks for old games. As of October of this year, the switch storefront had 49 Super Nintendo games. To put that in perspective, there are close to 800 total SNES games.

There are games that they can't port due to one reason or another. Maybe its a company they don't work with anymore, maybe the other company is defunct, who knows. Distribution of older media, specifically on consoles they aren't selling anymore, should be free for everyone to play, if you wanted to play it.

But I digress that's a whole different issue for a different time.
