Tell that to Nintendo, who have shut down many a rom site with ridiculous lawsuits. Don't get me wrong, obviously there is a whole discussion about how to deal with those situations, but they literally sued one site for nearly 2 million dollars, which broke down to 35k per title. Obviously that case was a little less gray as the guy was uploading newer stuff, but they have been known to sue sites that just upload for free the very old games that Nintendo no longer makes money from (Gamecube and prior).
