Personally, I think there's a good chance that Kyle did point his gun at the guy messing around with the car and might have even raised it at Zeminski right before Rosenbaum started chasing him. Logically it does track that something might have set Rosenbaum off beyond just a desire to cave Kyle's face in. Kyle bringing his weapon up toward Zeminski could have been the final catalyst to set Rosenbaum off. No one but the prosecution has claimed this. There's not only no evidence, there's nobody who claims he did either though. We can't just assume so then.
